Terms of Service

Accepting these terms
By using this website you accept these terms. If you do not accept them, please stop using the site.
Paid work is governed by the separate proposal or agreement signed by both parties. Where that agreement and these terms disagree, the signed agreement wins.
Who we are
Brandspire Growth provides the digital marketing services described on this website. You can contact us through the contact form on this website.
Using this website
You may read this site, share links to it, and send us an enquiry. You may not copy its design, text or graphics for your own commercial use, attempt to disrupt or gain unauthorised access to it, scrape it at a scale that affects its availability, or use it to send unlawful or abusive content.
What we provide
The pages on this site describe the services we offer in general terms. They are not an offer to contract, and nothing on them forms an agreement on its own.
The exact scope, deliverables, timeline and fees for any engagement are set out in a written proposal agreed with you before work starts. Anything not written into that proposal is not included.
We do not guarantee results
This matters more than anything else on this page, so it is stated plainly: we do not guarantee rankings, traffic, leads, sales, advertising performance, follower growth, or any other outcome.
Digital marketing results depend on your market, your competitors, your budget, the strength of your offer, the quality of your website, the decisions of third-party platforms, and customer behaviour. Most of those are outside our control and some are outside yours.
Any figures shown anywhere on this website are illustrative unless they are explicitly labelled as verified results from a named client. What we commit to is the work in the proposal, done properly, reported honestly.
What we need from you
Work stalls without these, so they are part of the deal:
- Give us accurate information, and tell us when something changes.
- Provide assets, access and approvals within the timescales we agree.
- Make sure you own or are licensed to use any content, images, footage, logos or trademarks you give us.
- Follow the rules of any advertising or social platform used in your campaigns.
- Pay invoices on the terms in your agreement.
Fees and payment
Fees, the payment schedule and invoicing terms are set out in your proposal and agreed before work begins.
Third-party costs — advertising spend, platform licences, software subscriptions, creator fees, stock media — are separate from our fees and are paid to those providers. We will tell you which costs are which before you commit to them.
Who owns what
This website, its design, text and graphics belong to us or to our licensors, and may not be reused without permission.
Ownership of deliverables we create for you transfers as set out in your agreement, normally once you have paid in full. Until then we keep ownership. We retain our own underlying tools, templates, frameworks and know-how, including anything developed before or outside your project.
Content you give us stays yours. You give us permission to use it for the purpose of delivering your project.
Third-party platforms
Our work often runs on platforms we do not control, such as search engines, advertising networks, social networks, hosting providers and analytics tools. We are not responsible for their availability, pricing, policy changes, account decisions or outages, and a change made by one of them is not a failure on our part.
Links from this site to other websites are provided for convenience. We are not responsible for their content.
Confidentiality
Each party will keep the other's non-public business information confidential and use it only for the purpose of the engagement. This does not apply to information that is already public, that was already known, or that must be disclosed by law.
Limiting our liability
We do not limit our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to exclude.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings, loss of data, or losses caused by a third-party platform's decisions. Our total liability for any engagement is limited to the fees you paid us for that engagement in the twelve months before the claim arose.
Ending an engagement
Either party may end an engagement as set out in the signed agreement. Fees for work completed up to the termination date remain payable, along with any third-party costs already committed on your behalf.
On request we will hand over the deliverables you have paid for in a reasonable format.
Governing law
These terms are governed by the laws of the United States, and the courts of the United States have exclusive jurisdiction over any dispute arising from them.
Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. Changes apply to your use of the website from that date, and do not change a signed agreement already in place.
